Former Federal Bureau of Investigation Employee Asserts Wrongful Dismissal Because of Pride Banner Presence

A veteran FBI operative has initiated a legal case claiming he was let go because of having a rainbow symbol in his desk area.

Based on the plaintiff, that was employed in the agency for 16 years, the termination in the past months is being described as “improper and biased”.

The complaint contends that the agency breached the employee’s free speech freedoms and engaged in retaliatory measures toward him for participating in constitutionally covered speech.

The former specialist is seeking a judicial directive to reinstate his employment at the bureau.

The detailed complaint, submitted in the US district court in Washington, D.C., alleges that the employee was fired from the FBI academy recently because of before showing the flag in his workspace.

Per the document, the LGBTQ+ banner was given to Maltinsky in recognition of his work to support the bureau’s diversity initiatives.

“From a young age, my only desire has been to serve my country and safeguard public safety alongside the talented and committed men and women of the FBI,” said Maltinsky.

He added, I exhibited that banner – which in 2021 was raised before the Los Angeles office – not as a political statement, but as a symbol of acceptance, solidarity and impartial service.

These principles that once made a robust FBI. Now it is a place where employees like me are singled out. I believe I was fired not due to my person, but what I am: a proud gay man,” he affirmed.

Sudden Termination Prior to Completion

Earlier this year, Maltinsky was accepted into the bureau’s agent training academy at the FBI facility, before what he described as “unexpected firing only weeks prior to finishing”.

The filing additionally states that at some point following the 2017 inauguration, a co-worker expressed an alleged concern to his manager concerning the exhibition of the rainbow banner.

As a precaution, the employee sought that the Chief Division Counsel at the L.A. office assess if the display of the symbol was acceptable,” the complaint stated.

It further mentioned, “The Chief Division Counsel informed the plaintiff that exhibiting of the symbol did not violate the agency’s standards.”

Notice of Firing

Despite this, on 1 October, the employee was notified of his firing.

In a letter referenced in the lawsuit, bureau chief Kash Patel stated, I have concluded that you exercised poor judgment with the presence of a partisan emblem at your workstation in your prior role at the Los Angeles Field Office.

Under Article II of the Constitution, and regulations of the U.S., your job with the FBI is concluded.”

Legal Comment

In a release provided recently, his attorney his counsel remarked, The government’s unlawfully firing him forms part of a broader effort to remove federal agencies of staff with different viewpoints, or belong to underrepresented communities, or those who oppose bias.

“David’s fight goes beyond his situation, but involves protecting the rights and freedoms of all public servants.”

Bureau Response

The bureau did not provide a statement on the lawsuit.

This legal action follows another one filed in September by previous top agency personnel who alleged they’d been unlawfully fired.

They claimed that the director stated he had been instructed by the White House to terminate any employee associated with an inquiry into Trump.

Additionally, the bureau terminated an experienced official recently following the official allegedly grew upset due to accounts that the FBI director used an official aircraft to be present at a sports event during which his partner rendered the Star-Spangled Banner.
